Terms and Conditions
The content of these terms and general conditions governs all contracts concluded between the buyer and the seller concerning the De Carlo website. A contract is subject to the version of the terms and conditions applicable at the time the contract is concluded.
Any condition from the buyer that contradicts or deviates from these terms and general conditions will not be considered an integral part of the contract unless expressly agreed to in writing by the seller.
GEOGRAPHICAL AREA
The products offered by De Carlo are delivered throughout Italy. For deliveries abroad, please contact us at the following mail address: customercare@oliodecarlo.com.
VALIDITY AND TERMINATION OF THE CONTRACT
All product information provided on De Carlo, such as technical specifications, images, or details, are non-binding and subject to change at any time, unless expressly identified as binding.
Offers on De Carlo are not binding, unlike the order placed by the buyer and the respective merchandise in the shopping cart. The seller confirms the receipt of the order via email only after verifying that it corresponds with the available stock. We reserve the right to cancel the order in particular cases such as: discontinued products, inventory errors, sudden unavailability of the product, pricing typos, and to contact the buyer to offer alternatives or cancel the order. This happens within 5 (working) days from the buyer’s submission. Finally, the order is definitively accepted with a shipping confirmation sent to the customer via email.
PLACING AN ORDER ON THE WEBSITE
The order process consists of four (4) consecutive steps. Once the selection is made and the cart is validated, customers must:
- Identify themselves
- Choose the delivery method
- Accept the General Sales Conditions by checking the appropriate box on the order summary page
- Choose the payment method.
Once the payment method is selected, customers must proceed with the payment to finalize the order, which will formally and definitively establish the sales contract between them and De Carlo.
DELIVERY OF GOODS
The indicated delivery times are not binding, unless otherwise specified in a separate agreement. However, the seller will do everything in their power to meet these times.
At the time of delivery of the goods by the courier, the Customer shall check that the number of packages delivered corresponds to that indicated in the transport document and that the packaging is intact, undamaged or in any case altered, checking for any signs indicating the breakage of the goods sent, such as, for example, the presence of leaking liquids on the packaging. Any damage to the packaging and/or the products and/or the mismatch in the number of packages must be immediately notified to the courier by the Customer, with a declaration of acceptance “subject to specific verification for damaged or missing goods” to be countersigned by the courier.
The Customer also undertakes to immediately report to the company by email any problems concerning the physical integrity, correspondence and/or completeness of the goods received, providing photographic documentation of any visible damage. Please ensure that the photos are clear and comprehensive, as they are essential for us to accurately assess the damage and process your refund. Please send to customercare@oliodecarlo.com Without this photographic documentation, we will be unable to proceed with the refund.
PRICE AND SHIPPING COSTS
The price indicated on the website is not binding and only becomes so at the time of the order’s shipping confirmation. It is possible that the prices listed on the website may be incorrect. In this case, the customer has the right to withdraw from the sales contract and receive a refund, if payment has already been made.
PAYMENT
Orders placed on De Carlo can be paid with a credit card.
RIGHT OF WITHDRAWAL
The customer, pursuant to Legislative Decree 06/09/05 No. 206 and subsequent amendments, has the right to withdraw from the contract and return the goods within 14 days of receipt, by notifying us in writing via registered letter with acknowledgment of receipt, addressed to:
Frantoio De Carlo
Via XXIV Maggio 54,
70020 – Bitritto (BA) Italy
Once we receive the above-mentioned withdrawal notice, De Carlo’s Customer Service will promptly provide the customer with instructions on how to return the goods, which must be received by De Carlo within 5 days from the authorization.
The right of withdrawal is subject to the following conditions:
- The right is applied to the purchased goods in its entirety. It is not possible to exercise the right of withdrawal only on part of the purchased goods;
- Sealed products once opened;
- The purchased goods must be intact and returned in their original packaging, complete in all its parts (including the packaging); to limit damage to the original packaging, we recommend, when possible, placing it in a second box with the destination address; in all cases, labels or adhesive tape should not be applied directly to the product’s original packaging.
By law, the return shipping costs are the responsibility of the customer; the shipping costs for delivering the goods to the customer will not be refunded, as the service has been duly provided.
The shipment, until confirmed as received in our warehouse, is fully the responsibility of the customer.
In the event of damage to the goods during transport, De Carlo will notify the customer of the incident (within 5 working days of receiving the goods in our warehouse) to allow them to file a complaint with the courier they selected and obtain a refund for the value of the goods (if insured); in this case, the product will be made available to the customer for return, while simultaneously canceling the withdrawal request.
De Carlo is not responsible in any way for damages or theft/loss of goods returned via uninsured shipments.
Upon arrival at our warehouse, the product will be inspected to assess any damage or tampering not resulting from transport. If the packaging and/or original packaging is damaged, De Carlo will retain a percentage, not exceeding 10% of the refund due, as a contribution towards the restoration costs.
